Alberta government applauds Supreme Court Ruling against federal carbon tax; one step remains

The province is celebrating a ruling from Alberta’s Supreme Court it its fight against the federal carbon tax.

The court, in a 4-1 ruling, says the federal carbon levy is seen as unconstitutional.

Justice Minister and Solicitor General, Doug Schweitzer feels optimistic as the final appeal will be heard in the Supreme Court of Canada in March.

“The Alberta Court of Appeal put together a 269 page decision outlining how our confederation is supposed to work,” says Schweitzer.

“The fact this federal carbon tax would upend 150 years of history in our country completely undermines provincial jurisdiction.”

Saskatchewan and Ontario also tried to fight the tax in court and both lost their cases, and Schweitzer says that helped the province win on Monday.

“We had the benefit on the cases in Ontario and Saskatchewan to refine our analysis,” explains Schweitzer. We focused on Section 92(a), which the province of Alberta fought so hard for, for the development of natural resources.”

“It is in the constitution and should not be undermined and that’s what we drove home in our case.”
